A Serious Concern: How MUD #2 Is Representing Ownership of Gulfstream Park

Dear Townewest HOA Homeowners,
There is another matter I believe our homeowners deserve to know about.
While reviewing the Fort Bend MUD #2 website, I came across its public announcement regarding the Gulfstream Park Project. The website contains the following statement:
“The stormwater detention facility will be located on the ‘West’ end (now owned by FB MUD #2) of ‘Townewest Gulfstream Park’.”
This statement is particularly concerning because it expressly represents to the public that Fort Bend MUD #2 now owns the western portion of Gulfstream Park.

The website explicitly describes the western end of Townewest Gulfstream Park as “now owned by FB MUD #2.”
That is not a minor distinction. An easement is not the same as a sale or transfer of ownership.
As I have stated before, Townewest HOA did not sell (ANY PORTION of) Gulfstream Park. What was granted was an easement, and the rights and responsibilities of each party must be determined by the actual legal documents governing the agreement.
The MUD’s website goes beyond describing the location of its stormwater detention project. By stating that the western end is “now owned by FB MUD #2,” it communicates a transfer of ownership to TOWNEWEST HOA homeowners and the general public.
Again, this public representation raises serious concerns about the MUD’s interpretation of the agreement and how it is communicating those rights to the community. It is also inconsistent with the position that the Association has maintained regarding the nature of the agreement.
Whether this representation was intentional or resulted from a misinterpretation of the agreement, the effect is the same: it gives the public the impression that the Association transferred ownership of a portion of Gulfstream Park.
I believe this needs to be addressed and formally clarified. Therefore, I have asked our legal counsel at Sears, Bennett & Gerdes to formally address this statement with MUD #2’s legal counsel and request that the website’s representation of ownership be corrected as it is inconsistent with the terms of the agreement.
Our responsibility as an Association is to protect our property interests and ensure that the rights granted to MUD #2 are not represented as something greater than what the agreement actually provides.
We cannot allow a public description of an agreement to become a substitute for the actual legal document.
Homeowners deserve to know the difference between granting an easement and transferring ownership. Those are two very different things, and the distinction matters when it comes to protecting the future of Gulfstream Park and the financial interests of our Association.
