Gulfstream Park: Our Community Deserves Answers and a Path Forward

Dear Townewest HOA Homeowners,
As President of the Townewest Homeowners Association Board of Directors, I believe our residents deserve a clear and honest explanation of the ongoing Gulfstream Park project, why progress has reached a standstill, and what needs to happen to move forward.
Gulfstream Park has been closed for nearly a year. During this time, our community has watched its park amenities disappear, including benches, tables, playground equipment, swing sets and a lot of soil. Residents have patiently waited for the work to be completed, expecting that the park would eventually be restored and available for everyone to enjoy again.
Unfortunately, we are now facing additional uncertainty about the project’s completion, the restoration of the park, and when our community can expect to use this important neighborhood asset again.
Townewest HOA homeowners need to understand the situation.
Ownership and the SIDE LETTER AGREEMENT
First, an important fact must be understood: Gulfstream Park belongs entirely to the Townewest HOA. Fort Bend County Municipal Utility District No. 2 (MUD #2) acquired an easement to carry out its construction project. The MUD did not purchase the park or acquire ownership of any portion of it.
The HOA entered into this arrangement in good faith to accommodate the MUD’s work on the detention pond and related infrastructure. The arrangement included a SIDE LETTER AGREEMENT signed by both parties.
That agreement must be respected as written.
The signed SIDE LETTER AGREEMENT does not state that the HOA must wait until the warranty period expires before proceeding with renovations to Gulfstream Park which will include renovations to the pavilions, installation of new playground equipment, benches, tables, light poles, irritagion, landscaping, and concrete walkways. The HOA’s position is that the terms of the agreement must be honored as signed and should not be expanded to impose restrictions that the agreement does not establish.
The Car Warranty Analogy: Does It Make Sense?
Consider a simple example.
Imagine purchasing a new car with a manufacturer’s warranty. The warranty protects you against certain defects for a specified period or mileage. Now imagine being told that you cannot drive or use your car for the specified period simply because the warranty remains in effect.
Would that make sense?
Of course not. A warranty is intended to provide protection against defects. It does not ordinarily prevent an owner from using or making improvements to their property.
The same question applies to Gulfstream Park. If the MUD can complete its construction work and restore areas affected by its project, why should the HOA be prevented from moving forward with the renovation and restoration of the remaining portion of its own park?
Naturally, the parties must coordinate work appropriately to protect newly completed improvements and any applicable warranty coverage. But coordination is not the same as prohibiting the HOA from proceeding with renovations based on a waiting period that the signed SIDE LETTER AGREEMENT does not establish.
A warranty should not become a blanket restriction on the use and improvement of an entire community park.
What Happens Next?
The project remains unfinished, and important questions about the remaining work and completion timeline still need to be addressed. In particular, the MUD has indicated that additional coordination concerning the revised irrigation system, including power and water, is necessary before landscaping can be completed.
Until those matters are resolved, the community continues to wait without a confirmed date for completion and reopening.
But completing the MUD’s construction project is only part of the picture. We must also address the restoration of Gulfstream Park and the return of the amenities our residents previously enjoyed.
Our homeowners deserve clear answers about what work remains, when it will be completed, and how the HOA can proceed with restoring the park while the MUD fulfills its obligations.
We cannot allow uncertainty and a lack of coordination to become an acceptable substitute for a plan.
My Commitment to Townewest
As your Board President, my responsibility is to protect the interests of our association, respect the agreements we have entered into, and advocate for the rights of the homeowners we represent.
That means insisting that the signed SIDE LETTER AGREEMENT be honored, that the HOA’s ownership rights be respected, and that the parties work toward a practical resolution that allows this project to move forward.
It also means keeping our residents informed. Homeowners should not have to rely on rumors or speculation to understand what is happening with their own community’s property.
Gulfstream Park is more than a construction site. It is a neighborhood asset intended to bring families together and provide a place for recreation and enjoyment. Our residents have already sacrificed access to this space for nearly a year. They deserve a clear path toward its restoration and reopening.
The Townewest HOA Board of Directors‘ and the Gulfstream Park Renovation Special Committee for objective is straightforward:
Respect the signed agreement, protect the HOA’s ownership rights, resolve the outstanding issues, and restore Gulfstream Park for the benefit of our entire community.
I will continue to advocate for these objectives and keep homeowners informed as meaningful developments occur because our community deserves transparency, accountability, and results.
Regards,
Robert S. Fuentes
