Dear Townewest HOA Homeowners,

I would like to provide an update regarding an important discussion that took place during last night’s Townewest Homeowners Association Board meeting concerning the Gulfstream Park renovation and the SIDE LETTER AGREEMENT with MUD #2.

Because there have been questions and varying understandings regarding the park and the agreement, I believe it is important that our homeowners have access to the same information discussed by the Board.

First, We Did Not Sell the Park

I want to be clear about this point: Townewest did not sell Gulfstream Park.

What was granted was an easement, and the rights and responsibilities associated with that easement are defined by the governing documents and agreements between the parties.

The Side Letter Agreement with MUD #2 was signed in February 2025. While I was the Board President who signed the agreement at that time, I believe the best way for our community to understand its terms is not through individual interpretations, but by reading the document itself and having the appropriate legal counsel explain its provisions when questions arise.

Reading the Agreement and Getting Legal Clarification

During last night’s meeting, the relevant portions of the Side Letter Agreement were read and discussed.

Attorney Tomas Romo of Sears, Bennett & Gerdes was present to provide legal guidance and clarification regarding the agreement and the respective rights and responsibilities of the parties.

His participation was particularly helpful in addressing questions that have arisen regarding the interpretation and implementation of the agreement.

One example discussed was the light poles at Gulfstream Park.

Questions have been raised regarding who owns the light poles, who is responsible for their maintenance after the applicable period, and what modifications or additions may be permitted. These are exactly the types of questions that should be answered by reviewing the actual agreement and obtaining legal clarification when necessary—not by relying on assumptions or informal interpretations.

Our Responsibility as Directors

As members of the Board of Directors, our responsibility is to understand the documents that govern the Association, protect the Association’s rights, and make decisions that safeguard the community’s financial interests.

That means we must take the time to review the agreements, understand the obligations they establish, and seek professional advice when there is uncertainty.

The Side Letter Agreement is an important document affecting the Gulfstream Park project. It should therefore be treated as such, with its provisions understood in their proper legal context.

Moving Forward

My goal is to ensure that homeowners have accurate information and that the Board moves forward based on the governing documents, rather than speculation or conflicting interpretations.

Let’s read the documents. Let’s ask questions. Let’s obtain clarification when needed. And let’s move forward together while protecting the rights and financial interests of the Townewest community.

I appreciate everyone who attended last night’s meeting and participated in the discussion. These conversations are important, and I believe transparency and a shared understanding of our governing documents are essential to moving the Gulfstream Park project forward responsibly.

Sincerely,

Robert S. Fuentes
President, Townewest Homeowners Association
